Rice County Attorney John Fossum is the featured guest on KDHL's AM Minnesota program at 9:30AM today.

I will ask Fossum what he thinks about the nomination of a new Supreme Court justice to replace Antonin Scalia. Should the president nominate someone, or should the next president make the selection?

We will also discuss last week's ruling by the Minnesota Court of Appeals affirming the test-refusal conviction of a former Minnesota Supreme Court candidate arrested for suspicion of drunken driving.

Michelle MacDonald Shimota was arrested in April 2013 after an officer saw her speeding and swerving. She refused to take a breath test and demanded to see a judge.

A jury ultimately convicted her of obstructing justice and refusing a chemical test. Shimota argued on appeal that the officer violated the law by failing to bring her to a judge immediately.

The Appeals Court ruled last week that an officer is not required to bring an arrestee to a judge before completing chemical tests.

Shimota ran for a seat on the Supreme Court in 2014 and lost to Justice David Lillehaug.

I'm really curious to hear what Fossum thinks about the appointment of a replacement on the federal Supreme Court.
