Matthew Hartley, 34, is on trial in Scott County District Court. He is charged with criminal vehicular homicide in the death last September of 24-year-old Army Specialist Mollie Mahowald.

According to KSTP, prosecutors will show Mahowald died because of the actions and inactions of Hartley. They also said that her friends there that night will be called to testify.

According to police statements, they say they got a call about a hit and run accident on Main Street in Elko New Market on Sept. 25 about 2:30AM. Their evidence that they found led detectives to arrest Hartley 13 hours later. Witnesses claim Hartley drove away from a local bar after drinking on his motorcycle at a high rate of speed and hit Mahowald.

Robert Miller, Hartley's defense attorney, is arguing that the state's case does not provide proof that Hartley was intoxicated.
