The charges say officers on patrol saw Hernandez-Aguilar driving in downtown Rochester and knew had a revoked license.

The officers were stopped at a red light in an unmarked squad vehicle at the intersection of South Broadway Ave. and 4th St. when a vehicle driven by Hernandez-Aguilar pulled up next to them, the complaint says.

The light turned green and the officers pursued Hernandez-Aguilar southbound on Broadway. He made a U-Turn near the road’s intersection with 1st St. SE and increased his speed as he headed northbound, the complaint says.

Officers continued their pursuit and activated the squad vehicle’s emergency lights. Hernandez-Aguilar then turned eastbound on 4th St. SE and continued increasing his speed, according to the court document.

Due to the speed Hernandez-Aguilar was driving at, the officers terminated their pursuit, the complaint indicates. Police then went to Hernandez-Aguilar’s home in the 1300 block of Marion Rd. SE.

They saw the suspect vehicle parked in front of a trailer with lights on and running, the charges say. Officers used their squad’s public address system to call out  Hernandez-Aguilar and inform him he was under arrest.

The lights in the trailer then shut off and no more movement was seen in the trailer. Officers then left the area and obtained surveillance footage that documented the pursuit, according to the complaint.

Police then saw the suspect vehicle in northwest Rochester on Monday evening. They went to a nearby restaurant and arrested  Hernandez-Aguilar, who was working in the kitchen, the court document says.

In a statement to police, Hernandez-Aguilar admitted to fleeing police, saying he thought they were Immigrations and Customs Enforcement officers, the charges say.

Hernandez-Aguilar was released without bail following his first court appearance on Tuesday. He is due back in court later this month.
