A 41 year old Faribault man was formally charged today with four felony counts in alleged connection with the stabbing of two men at his residence early yesterday morning.

Martin Fernandez-Velazquez has been charged with one count of second degree murder with intent, not premeditated. One count of first degree assault causing great bodily harm.  Two counts of assault in the second degree with a dangerous weapon.

The criminal complaint says 26 year old Julio Ceasar Deleon Lopez "had a stab wound to the back, one on his left side near his heart, one stab wound on his left elbow, and one stab wound on the right side of his abdomen near his lung."

" In addition Lopez had injuries to his hands consistent with defensive injuries."

Fausto Marino Alvarez Perez , 58, "had a stab wound to his lower left leg and one in the middle of his back."

"Alvarez also had a significant defensive injury to his left hand", according to the criminal complaint.

The complaint says alcohol was involved.

The complaint states a 911 call was received from Velazquez, "who stated he had stabbed his friend and he was sorry.  A second 911 call was made by Lopez who asked the dispatcher for help, saying "I'm bleeding out."

When asked who hurt him he said, "I don't know his name, he's a Mexican guy with a shaved head, he's still inside the trailer."

Lopez added, according to the criminal complaint, "I'm about to die right now, I need an ambulance."

Lopez and Alvarez were airlifted to North Memorial Medical Center for treatment for their injuries which the complaint said "appeared to be life threatening."  At latest report they were both in stable condition.

Velazquez was arrested, after Miranda, with the assistance of an interpreter he told authorities he had no injuries from the fight and that he resides in the trailer with Alvarez whom he pays rent to live there.

Velazquez told officers he started drinking beer about 3:00 p.m.  Alvarez joined him between 5:00 p.m. and 6:00 p.m. and Lopez described as "a friend from Texas" showed up around 6:00 p.m. to 7:00 p.m. and brought beer with him."

The three then went to a video store to rent some movies and went to Hy Vee to purchase more beer.

According to the criminal complaint Velazquez said after they got back to the trailer Lopez started to "offend" Velazquez.  "Velazquez claimed that Lopez threatened him, Velazquez got scared, grabbed a knife and stabbed Lopez.  Velazquez said he stabbed Lopez in the stomach and the chest, then Lopez turned around and Velazquez stabbed him the back.  Velazquez said this was necessary because Lopez, "was heading toward a room with a bigger knife."

The complaint goes on to say, "Velazquez did not remember hurting Alvarez but later agreed he may have been cut trying to help Lopez.  Velazquez later claimed Alvarez might have been hurt falling down some stairs, and did not think he hurt Alvarez."

Velazquez was not arraigned today according to Rice County Attorney John Fossum because they couldn't find a interpreter for him.

By law if an interpreter can't be provided by noon Friday then he would be able to leave jail.
